For Grand Prize, winner is required to sign Sponsor’s designated form of RV Rental agreement.

1. FACEBOOK NOT INVOLVED

The #ThrowbackThursday Go RVing Contest (the “Contest”) is in no way sponsored, endorsed or administered by, or associated with Facebook (the “Social Platform”). You understand that you are providing your information to Go RVing Canada (the “Sponsor”) and not to the Social Platform. The information you provide will only be used for the administration of this Contest in accordance with the Sponsor’s privacy policy (see below). The Social Platform is hereby completely released of all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to the Social Platform. You may only use one (1) Facebook account (an “Account”) to participate in this Contest. Multiple Accounts are not permitted.

2. CONTEST PERIODS:

The Contest will run as a series of three (3) one (1)-day contest periods as hereinafter set forth, each beginning on the applicable Thursday at 12:00:01 a.m. Eastern Time (“ET”) and ending that same Thursday at 11:59:59 p.m. ET (each a “Contest Period” and collectively the “Contest Periods”). The first Contest Period will take place on Thursday, April 16, 2015, beginning at 12:00:01 a.m. (ET) and ending at 11:59:59 p.m. ET. The second Contest Period will take place on Thursday, April 23, 2015, beginning at 12:00:01 a.m. (ET) and ending at 11:59:59 p.m. ET, and the third and final Contest period will take place on April 30, 2015, beginning at 12:00:01 a.m. (ET) and ending at 11:59:59 p.m. ET.

3. ELIGIBILITY TO ENTER:

To be eligible to enter the Contest and win a Prize (as defined below), an individual must (i) be a resident of Canada (excluding Quebec); and (ii) have reached the legal age of majority in his/her province or territory of residence. Employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of the Sponsor, its parent company(ies), subsidiaries, affiliates, distributors, suppliers, advertising/promotion agencies and any other individual or entity involved in the development, production, implementation, administration, judging or fulfillment of the Contest (collectively, the “Contest Parties”) are not eligible to enter or win.

4. AGREEMENT TO BE LEGALLY BOUND BY RULES:

By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these Official Rules and Regulations (the “Rules”).

5. HOW TO ENTER:

NO PURCHASE NECESSARY.

To enter:
Log-in to your Facebook Account and, during the applicable Contest Period, post a photograph (the “Photo”) that depicts an outdoor or camping-themed childhood memory (the “Theme”) to the Go RVing Canada Facebook Page Wall using all three (3)of the following Hashtags: #ThrowbackThursday, #BringBackWildhood AND #Contest (collectively, the “Hashtags”).To participate in this Contest, you must have a valid Account. If you do not have a valid Account, visit www.facebook.com and register in accordance with the enrolment instructions for a free Account. For your entry to be eligible, your Account must be set to public and not private, while participating in the Contest.IMPORTANT NOTE: Using the Sponsor’s products will not increase or otherwise impact your chances of winning in this Contest. To be eligible, your Photo must: (i) reflect the Theme; (ii) be in accordance with these Rules, including, but not limited to, the specific Submission Requirements listed below in Rule 8 (all as determined by Sponsor in its sole and absolute discretion); and (iii) comply with all of the terms, policies and guidelines of the Social Platform (all as determined by Sponsor in its sole and absolute discretion). When all required steps as set out above are complete, you will receive one (1) entry (Photo, as well as any content contained in or otherwise referenced in the accompanying post, is included in the reference to the “Entry”). To be eligible, your Entry must be submitted and received in accordance with these Rules within the applicable Contest Period.

6. ENTRY LIMIT:

There is a limit of five (5) Entries per person/Account permitted in respect of each Contest Period, but each Entry must include a unique and original Photo (do not submit the same Photo or substantially the same Photo more than once in the Contest). If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) submit an Entry containing a Photo that is not unique and original (as determined by Sponsor in its sole and absolute discretion); (ii) use multiple names, identities, email addresses, Accounts from the same Social platform and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest; or (iii) submit more than the permitted number of Entries; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified from the Contest. The Contest Parties, Facebook Inc., and each of their respective agents, employees, directors, successors, and assigns (collectively, the “Released Parties”) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void). An Entry may be rejected if, in the sole and absolute discretion of the Sponsor: (i) the Entry is not submitted and received in accordance with these Rules; or (ii) the Photo accompanying an Entry is not in compliance with these Rules, including, without limitation, the specific Submission Requirements listed below in Rule 8 (all as determined by Sponsor in its sole and absolute discretion).

7. VERIFICATION:

All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).

8. SUBMISSION REQUIREMENTS:

BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE PHOTO) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE PHOTO); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A WINNER, ANY PRIZES (INCLUDING ANY USE OR MISUSE OF ANY PRIZES). THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZES.

Any Photo submitted with an Entry must never have been previously selected as a winner in any other contest. To be eligible for entry in this Contest, any Photo you submit must meet all format requirements of the Social Platform.

By participating in the Contest, each entrant submitting an Entry hereby warrants and represents that any Photo he/she submits:
i. is original to him/her and that the entrant has obtained all necessary rights in and to the Photo for the purposes of entering the Photo in the Contest;

ii. does not violate any law, statute, ordinance or regulation;

iii. does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the legal age of majority in their jurisdiction of residence (note: if you cannot obtain the consent of an individual appearing in your Photo, then his/her face must be blurred out so as to be unrecognizable);

iv. will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and

v. is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity (partial or otherwise); alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups (including, without limitation, any competitors of Sponsor); content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsor; any identifiable third party products, trade-marks, brands and/or logos, other than those of Sponsor; conduct or other activities in violation of these Rules; and/or any other content that is or could be considered inappropriate, disparaging, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

The Sponsor and/or its promotional agency or designated content moderator (the “Reviewer”) may initially screen every Photo submitted. Any Photo that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules is subject to disqualification. The Reviewer reserves the right, in its sole and absolute discretion at any time, to request an entrant to modify, edit and/or re-submit his or her Photo, in order to ensure that the Photo complies with these Rules, or for any other reason.

9. LICENSE:

Without limiting the terms, polices and guidelines of the Social Platform, by entering the Contest and submitting an Entry, each entrant: (i) grants to the Sponsor and BLACKS Photo Corporation, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use the Photo associated with the Entry, in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her Photo in favour of the Sponsor (and anyone authorized by the Sponsor to use the Photo); and (iii) agrees to release, indemnify and hold harmless the Released Parties from and against any and all claims related, directly or indirectly, to his/her Photo– including, without limitation, claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action. For greater certainty, the Sponsor reserves the right, in its sole discretion, to modify, edit or remove any Entry (or a component thereof – including, but not limited to, the Photo), or to request an entrant to modify or edit his or her Entry (or a component thereof – including, but not limited to, the Photo), if a complaint is received with respect to the Entry (or a component thereof – including, but not limited to, the Photo), or for any other reason at any time. If such an action is necessary at any time, then the Sponsor reserves the right, in its sole and absolute discretion, to: (i) disqualify the Entry; (ii) disqualify the entrant and any or all of his/her Entries; and/or (iii) to take whatever action it deems necessary based on the circumstances to ensure that the Contest is conducted in accordance with the letter and spirit of these Rules.

10. THE PRIZES:

There are a total of four (4) prizes (each, a “Prize” and collectively, the “Prizes”) available to be won in the Contest, as follows; one (1) prize per Contest Period (each, a “Thursday Prize”) – three (3) Thursday Prizes in total, and one (1) grand prize (the “Grand Prize”), as more particularly described below, and to be awarded as set forth in Rule 11 below.

Each Thursday Prize consists of a Canon PowerShot D30 camera and a voucher redeemable for a set of nine (9) 8”x8” thick laminated canvases. Each Thursday Prize has a total approximate retail value of $400.00 CAD. There is a limit of one (1) Thursday Prize per person/Account.

The Grand Prize consists of a trip for the confirmed winner and up to three (3) travel companions (each, a “Guest”), which includes: (i) use of a Recreational Vehicle as designated by the Sponsor, excluding a Class A (the “RV”) for three (3) days; and (ii) one (1) $200 CAD gas card (subject to the terms and conditions of the issuer); and (iii) a campsite rental up to $150 CAD (subject to the terms and conditions of the campsite), collectively with an approximate retail value of $1,500.00 CAD.
Without limiting the generality of the foregoing, the following general conditions apply to the Prizes: (i) Prize must be accepted as awarded and is not transferable, assignable and/or or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions except at Sponsor’s option; (iii) the voucher valid for a set of nine (9) 8”x8” canvases must be utilized before August 31, 2015; (iv) BLACKS Photo Corporation will cover the cost of shipping the canvases to the winner; (v) all components of the Grand Prize must be utilized within six (6) months of the Grand Prize being awarded (otherwise the Grand Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (vi) if the confirmed Grand Prize winner and/or any of his/her Guest(s) does not utilize any part(s) of the Grand Prize, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Grand Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (viii) all arrangements relating to the Grand Prize must be made through the Sponsor or its designated agents; (ix) by accepting the Prize, the confirmed winner agrees to waive all recourse against the Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part; (x) each of the confirmed Grand Prize winner’s Guests must: (a) either be of the age of majority in his/her province/territory of residence or have the express written consent (in form and substance satisfactory to the Sponsor, in its sole and absolute discretion) to accompany the confirmed winner; and (b) sign (and have his/her parent/legal guardian if he/she is under the age of majority in his/her jurisdiction of residence sign) and return the Sponsor’s release (by the date indicated on the release form) indicating that he/she waives all recourse against the Released Parties relating to his/her participation in the Grand Prize (including, without limitation, any travel related thereto); (xi) colour and other specifics of the RV will be determined at the sole and absolute discretion of the Sponsor and are subject to availability; (xii) upon notification, the confirmed Grand Prize winner will be required to personally take delivery of the RV from a location within Canada reasonably close to the winner’s residence, as determined by Sponsor, in its sole and absolute discretion, and will be required to present adequate personal identification (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification); (xiii) RV will not be released unless and until the confirmed winner first shows proof (in a form acceptable to the Sponsor) of having a valid driver’s license (equivalent to a full “G” class license in Ontario) in the province/territory in which he/she resides and proof (in a form acceptable to the Sponsor) of being insurable; (xiv) confirmed winner is solely responsible for all expenses that are not included in the Grand Prize description above, including, but not limited to: obtaining a valid driver’s license; insurance; additional fuel; meals and drinks; gratuities; entertainment; health and travel insurance; excess kilometre charge per KM in excess of the kilometre limit specified by the Rental Agreement; and items of a personal nature. In addition, the confirmed winner will be required to enter into the Sponsor’s designated form of rental agreement (the “Rental Agreement”) prior to being able to take possession of the RV.

Without limiting the effect of the Rental Agreement, the following conditions shall apply to the use of the Vehicle: (a) vehicle must be returned to the Location on the date and time specified by the rental agreement; (b) confirmed winner shall be solely responsible for any and all damages to the Vehicle that are not covered by the insurance; (c) only the confirmed winner and guests outlined in the rental agreement (who must have a valid driver’s license (equivalent to a full “G” class license in Ontario) in the province/territory in which he/she resides and proof (in a form acceptable to the Sponsor) of being insurable) will be authorized to drive the Vehicle; (e) smoking is NOT permitted in the Vehicle; and (f) the Vehicle must be returned in the same condition as received by the confirmed winner, normal wear and tear excepted.

No difference, if any, between the approximate retail value of any Prize, as stated in these Rules, and the actual value of such Prize, or any component thereof, will be awarded.


11. WINNER SELECTION PROCESS:

On each of the three (3) Fridays following the immediately preceding Contest Period, beginning on Friday, April 17, 2015 in Toronto, Ontario at approximately 4:30 p.m. ET, one (1) entrant will be selected by random draw (each a “Friday Draw”) from among all eligible Entries submitted and received in accordance with these Rules in respect of the applicable Contest Period (non-winning entries for any Contest Period will not be eligible for any subsequent Contest Period). The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules in respect of the applicable Contest Period.

On Tuesday, May 5 at approximately 4:30 p.m. ET, one (1) entrant will be selected by random draw (the “Grand Prize Draw”) from among all eligible Entries submitted and received in accordance with these Rules in respect of the three Contest Periods. The odds of winning depend on the number of eligible Entries submitted and received in accordance with these Rules.

12. WINNER NOTIFICATION PROCESS:

The Sponsor or its designated representative will make a minimum of three (3) attempts to contact the selected entrant, using the Social Platform, within five (5) business days of the Friday Draw or Grand Prize Draw, as applicable. If the selected entrant cannot be contacted within five (5) business days of the applicable draw, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries submitted and received in accordance with these Rules during the applicable Contest Period (or, in the case of the Grand Prize, in the Contest), in which case the foregoing provisions of this section shall apply to such newly selected entrant.

13. WINNER CONFIRMATION PROCESS:

BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, the selected entrant will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize (as awarded); (iii) releases the Contest Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the internet. If the selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; (c) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; and/or (d) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries submitted and received in accordance with these Rules during the applicable Contest Period (or, in the case of the Grand Prize, in the Contest), in which case the foregoing provisions of this section shall apply to such newly selected entrant.

14. GENERAL CONDITIONS:

All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules. ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

The Released Parties will not be liable for: (i) any failure of the Social Platforms during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website or delay; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (v) any combination of the above.

In the event of a dispute regarding who submitted an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to deem the Entry to have been submitted by the authorized account holder of the Account used at the time of entry. “Authorized account holder” is defined as the person who is assigned the Account by the Social Platform. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the Social Platform Account associated with the Entry in question.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: http://gorving.ca/privacy-policy/). This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of his/her personal information.
